A wave of misinformation and rumor on COVID-19 floods phones, forcing the government to issue an advisory.WORLD's battle against the CORONA VIRUS has many obstacles - large crowds, a stretched health system and inadequate infrastructure - as the total number of infections rose to 990186 approx.. total no of death cases in the world rose to 50691 approx.. and total recovery cases in the world 206376 approx. as per data show on google. so its create a critical situation for the human. its spread in the highly ratio in USA, ITALLY, SPAIN, GERMANY, CHINA. in spite off it the whole world have affected from this virus.
so in this bad situation most of users using social media are spreading fake videos,messages, photos etc. which create a terror of corona virus in the mind of mob. no doubt the Noble Coronavirus is a dangerous virus but our social responsibility is not to spread fake rumor in india its a offence as per Indian Penal Code. Sec.505, and if any body not obey the order by the Indian administrative that is also offence as per Indian penal code Sec. 188 , if any false information have given to the police then its a offence as per Indian Penal Code sec.182.
505. Statements conducing to public mischief.
1. Whoever makes, publishes or circulates any statement, rumor or report,—
(a) with intent to cause, or which is likely to cause, any officer, soldier, [sailor or airman] in the Army, 4[Navy or Air Force] [of India] to mutiny or otherwise disregard or fail in his duty as such; or
(b) with intent to cause, or which is likely to cause, fear or alarm to the public, or to any section of the public whereby any person may be induced to commit an offence against the State or against the public tranquility; or
(c) with intent to incite, or which is likely to incite, any class or community of persons to commit any offence against any other class or community, shall be punished with imprisonment which may extend to [three years], or with fine, or with both.
(2) Statements creating or promoting enmity, hatred or ill-will between classes.—Whoever makes, publishes or circulates any statement or report containing rumour or alarming news with intent to create or promote, or which is likely to create or promote, on grounds of religion, race, place of birth, residence, language, caste or community or any other ground whatsoever, feelings of enmity, hatred or ill-will between different religious, racial, language or regional groups or castes or communities, shall be punished with imprisonment which may extend to three years, or with fine, or with both.
(3)Offence under sub-section (2) committed in place of worship, etc.—Whoever commits an offence specified in sub-section (2) in any place of worship or in an assembly engaged in the performance of religious worship or religious ceremonies, shall be punished with imprisonment which may extend to five years and shall also be liable to fine.
(Exception) —It does not amount to an offence, within the meaning of this section when the person making, publishing or circulating any such statement, rumour or report, has reasonable grounds for believing that such statement, rumour or report is true and makes, publishes or circulates it [in good faith and] without any such intent as aforesaid.
Section 188 in The Indian Penal Code
Disobedience to order duly promulgated by public
servant.—Whoever, knowing that, by an order promulgated by a public
servant lawfully empowered to promulgate such order, he is directed to
abstain from a certain act, or to take certain order with certain
property in his possession or under his management, disobeys such
direction, shall, if such disobedience causes or tends to cause
obstruction, annoyance or injury, or risk of obstruction, annoyance or
injury, to any person lawfully employed, be punished with simple
imprisonment for a term which may extend to one month or with fine
which may extend to two hundred rupees, or with both; and if such
disobedience causes or trends to cause danger to human life, health or
safety, or causes or tends to cause a riot or affray, shall be punished
with imprisonment of either description for a term which may extend to
six months, or with fine which may extend to one thousand rupees, or
with both. Explanation.—It is not necessary that the offender should
intend to produce harm, or contemplate his disobedience as likely to
produce harm. It is sufficient that he knows of the order which he
disobeys, and that his disobedience produces, or is likely to produce,
harm. Illustration An order is promulgated by a public servant lawfully
empowered to promulgate such order, directing that a religious
procession shall not pass down a certain street. A knowingly disobeys
the order, and thereby causes danger of riot. A has committed the
offence defined in this section.
Section 182 in The Indian Penal Code
False information, with intent to cause public servant to use
his lawful power to the injury of another person.—Whoever gives to any
public servant any information which he knows or believes to be false,
intending thereby to cause, or knowing it to be likely that he will
thereby cause, such public servant—
a) to do or omit anything which such public servant ought not to do or
omit if the true state of facts respecting which such information is
given were known by him, or
b) to use the lawful power of such public servant to the injury or
annoyance of any person, shall be punished with imprisonment of either
description for a term which may extend to six months, or with fine
which may extend to one thousand rupees, or with both. Illustrations
c) A informs a Magistrate that Z, a police-officer, subordinate to such
Magistrate, has been guilty of neglect of duty or misconduct, knowing
such information to be false, and knowing it to be likely that the
information will cause the Magistrate to dismiss Z. A has committed the
offence defined in this section.
d) A falsely informs a public servant that Z has contraband salt in a
secret place knowing such information to be false, and knowing that it
is likely that the consequence of the information will be a search of
Z’s premises, attended with annoyance to Z. A has committed the offence
defined in this section.
e) A falsely informs a policeman that he has been assaulted and robbed in
the neighbourhood of a particular village. He does not mention the name
of any person as one of his assistants, but knows it to be likely that
in consequence of this information the police will make enquiries and
institute searches in the village to the annoyance of the villages or
some of them. A has committed an offence under this section.
